Terms and Conditions

Welcome to Tuzzow. By using this website or engaging our services, you agree to these clear terms. If you do not agree, stop using the site and do not proceed with any payment.

1. Acceptance of Terms

The Client formally accepts these Terms and Conditions upon payment of the first invoice or deposit. This action forms a binding contract between the Client and Tuzzow Digital Studio.

2. Services and Deliverables

  • Service Scope: All services (web design, branding, marketing) are defined in a separate written proposal or agreement.

  • Extra Work: Any work requested outside of the signed agreement’s scope will require a new quote and an additional fee.

  • Service Completion: Services are considered fully delivered and complete 7 days after the live site review is initiated, and upon Tuzzow receiving the final payment.

3. Financial Terms and Payments

  • Payment Structure: Projects are generally structured as a 50% upfront deposit and 50% upon final completion.

  • Deposits: The initial deposit is non-refundable. This covers project planning and resource allocation. A refund will only be issued if Tuzzow fails to start work within 30 days of receiving the deposit.

  • Late Payments: If any invoice is late, Tuzzow will immediately stop all work and service delivery. Work will only resume once the outstanding balance is paid in full.

  • Final Payment: Access to final files, code, and website administration is granted only after the final payment has been fully cleared.

4. Revisions and Feedback

Revisions are handled based on the service type:

A. Web Development & Digital SystemsProjects include a 7-day review period after the site goes live. This allows for minor styling and content edits only. Major structural changes, new features, or scope changes are billed separately.
B. Branding & Graphics (Logos, Flyers, Posters)Projects include a maximum of two (2) rounds of revisions on the initial design concepts. Revisions requested after the second round, or after final sign-off, will incur an additional fee.
C. SEO & Digital Marketing (Strategies, Reports)No revision period applies. Strategy deliverables are based on data and are delivered as final products. Changes to the core strategy require a new scope definition.

5. Intellectual Property (IP) and Ownership

  • Tuzzow Property: All designs, code, visuals, and concepts created by Tuzzow remain our exclusive property until the final payment has been cleared.

  • Client Ownership: Final ownership of the delivered assets (website, logo) transfers to the Client only after Tuzzow receives and clears the full 100% project payment.

  • Third-Party Assets: Stock images, fonts, and external paid assets may be used. These assets remain under the license of their original creators.

6. Use of Client Work

Tuzzow retains the right to display all completed projects on our website, social media, and in marketing materials for portfolio purposes. If the Client requires strict confidentiality, this must be requested and agreed upon in writing at the start of the project.

7. Website Maintenance

Post-launch support, updates, and maintenance are not included in the project fee. Bug fixes are warranted for 30 days after launch. All ongoing support is subject to a separate fee and maintenance agreement.

8. Third-Party Services and Liability

  • Third Parties: We utilize third-party tools (hosting, domain registrars, payment systems, plugins) to deliver services.

  • Liability: Tuzzow is not responsible for any downtime, outages, security breaches, or errors caused by external third-party services.

9. Limitation of Liability

Tuzzow is not responsible for any loss of revenue, lost data, business interruption, or damages caused by website errors, misuse, or downtime. All services are provided “as is,” without any guarantee of future profitability.

10. Privacy and Data Sharing

We collect basic contact and company information to communicate with clients. We share data with third parties (like Google, Meta, and HubSpot) solely for the purpose of tracking marketing performance, scheduling meetings, and serving relevant ads. We do not sell data.

11. Governing Law

This agreement is governed by the laws of Tanzania.
